Dektori User Terms and Conditions

Part 1: Introduction and Acceptance of Terms
Welcome to Dektori ("Company,” "we,” "us,” or "our”). These Terms and Conditions ("Terms”) govern your access to and use of our platform, including the website https://www.dektori.com (the "Platform”). By accessing or using the Platform, you acknowledge that you have read and understood these Terms and agree to be legally bound by them, together with our Privacy Policy. If you do not agree with these Terms, you must not use the Platform. Your acceptance of these Terms is a condition of your use of the services provided through Dektori.
Part 2: Nature of Services
Dektori is a health education platform that connects individuals with independent U.S.-licensed healthcare professionals ("Providers”) who participate solely as health educators. Providers offer general health education and wellness insights based on the information you voluntarily share. Importantly, Dektori itself does not provide medical advice, diagnosis, prescriptions, treatment, or second opinions.
The Platform is not a medical practice and does not establish a physician–patient relationship. All sessions, communications, and content delivered through Dektori are intended strictly for informational and educational purposes. They are not a substitute for professional evaluation, diagnosis, or treatment by a licensed healthcare provider in your jurisdiction. Because interactions on Dektori take place remotely and without physical examination, they should not be interpreted as medical advice or clinical judgment.
Important Disclaimer: Providers on the Platform act only in an educational capacity. They do not issue prescriptions, create treatment plans, or provide official diagnoses. You should never delay seeking professional medical care or ignore medical advice from a licensed provider based on any information received through Dektori. If you are experiencing a medical emergency, you must immediately call your local emergency number or go to the nearest emergency facility.
Part 3: No Doctor–Patient Relationship with Dektori
Dektori is a technology platform that facilitates access to educational discussions about health and wellness. Your use of the Platform, including communications with Dektori staff or access to materials on our website, does not create a doctor–patient, therapist–patient, or any other healthcare provider–patient relationship with Dektori. All information provided, whether in a session with a Provider or through the Platform itself, is educational in nature and not a substitute for professional medical services.
If you choose to engage with a Provider through the Platform, your relationship is exclusively with that Provider acting as a health educator. These interactions are not clinical consultations and should not be regarded as the practice of medicine. Providers do not perform examinations, prescribe medications, or diagnose conditions through Dektori. Dektori does not oversee the content of education sessions and does not guarantee the accuracy of information shared by Providers. You remain solely responsible for any decisions you make based on information obtained through the Platform, and you should always consult with a licensed healthcare provider in your jurisdiction for diagnosis or treatment of any condition.
Part 4: Eligibility and User Responsibilities
To use the Platform, you must be at least eighteen (18) years old and legally capable of entering into binding agreements. Users between the ages of thirteen (13) and seventeen (17) may use Dektori only with the involvement and permission of a parent or legal guardian, who must create and manage the account. Children under thirteen (13) years of age are not permitted to use the Platform.
You are responsible for providing accurate and complete information when creating an account and for maintaining the confidentiality of your login credentials. You agree to notify us promptly if you become aware of any unauthorized use of your account. You are solely responsible for all activities that occur under your account.
You agree to use the Platform only for lawful, personal, and non-commercial purposes in compliance with these Terms. Misuse of the Platform is strictly prohibited. This includes, but is not limited to, misrepresenting your identity or health information, impersonating others, introducing harmful code such as malware or viruses, disrupting the security or performance of the Platform, attempting unauthorized data collection, harassing or defaming others, or exploiting the Platform for commercial purposes. Dektori reserves the right to suspend or terminate your account, without prior notice, if you violate these Terms or misuse the Platform in any way.
Part 5: Use Outside the United States — International Users
Dektori is operated from the United States and functions under U.S. law. The Platform is designed to connect users located outside the United States with U.S.-licensed Providers. If you access the Platform from outside the United States, you do so voluntarily and are responsible for complying with all laws that apply in your country of residence.
The Providers on Dektori are licensed to practice medicine in the United States and may not be licensed in your jurisdiction. All education sessions are based on U.S. medical standards and regulations, which may differ from those in your country. You acknowledge that using Dektori outside the U.S. may not be lawful in some jurisdictions and that Dektori makes no representation about the suitability of its services in your location. You should not use the Platform if doing so would violate any law in your jurisdiction. For all medical concerns, especially when local standards differ, you should consult with a healthcare provider licensed in your country.
Part 6: Privacy and Information Sharing
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms. By using Dektori, you acknowledge and consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
Although Dektori is not a healthcare provider and is not a covered entity under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), we voluntarily adopt privacy and security measures consistent with HIPAA standards to protect personal health information (PHI). Any information you share is provided voluntarily and is processed and stored in the United States. You acknowledge that privacy and data protection laws in the United States may differ from those in your home country.
We implement comprehensive technical and organizational safeguards, including encryption, firewalls, access controls, and security logging. Data may be processed by trusted third-party providers for services such as hosting, translation, or payment processing. You retain certain rights with respect to your data, including rights of access, correction, deletion, restriction, and portability, as detailed in the Privacy Policy.
Part 7: Educational Consultation Timing and Session Rules
To ensure fair use of the Platform, the following rules apply to consultations:
Scheduling and Messaging: You may communicate with your assigned Provider up to 24 hours before a scheduled session. Messaging support outside this window is not guaranteed.
Cancellations and Rescheduling: You may cancel without penalty at least 24 hours before the start time. Sessions canceled less than 12 hours before the scheduled start will receive a 20% refund. You may reschedule up to 24 hours in advance by notifying Dektori or the Provider.
Issue Reporting: You have seven (7) days after a consultation to raise concerns or disputes. Issues reported after this period will not be reviewed.
Session Inactivity: If you become unresponsive during a session, the Provider may end it after five minutes of inactivity. If neither party is active within one hour of the scheduled start, the session will automatically be marked as complete.
Policy Updates: Dektori reserves the right to update consultation rules, cancellation policies, and refund criteria at any time. Continued use of the Platform after updates constitutes acceptance of the revised rules.
Part 8: Intellectual Property and Limited License
All materials on the Platform, including text, graphics, images, audio, video, software, and design elements, are the property of Dektori or its licensors and are protected by intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to use the Platform for your personal and non-commercial purposes, provided that your use complies with these Terms.
You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from any part of the Platform without our prior written consent. You may not reverse engineer or attempt to discover the source code of the Platform. All rights not expressly granted are reserved by Dektori and its licensors.
Part 9: Disclaimers and Limitation of Liability
The Platform and all information, content, and services provided through it are offered on an "as is” and "as available” basis, without warranties of any kind. Dektori expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not guarantee uninterrupted, secure, or error-free operation of the Platform.
Your use of the Platform is at your sole risk. To the fullest extent permitted by law, Dektori and its affiliates, directors, employees, agents, and Providers will not be liable for any damages arising from your use of the Platform. This includes indirect, incidental, consequential, or punitive damages, as well as losses of profits, data, or goodwill.
Part 10: Indemnification
You agree to indemnify and hold harmless Dektori, its affiliates, officers, employees, agents, licensors, and Providers from any claims, liabilities, damages, or expenses, including reasonable attorneys’ fees, that arise from your use of the Platform, your violation of these Terms, your breach of applicable law, or any content you submit. You agree to cooperate fully in the defense of such claims and acknowledge that Dektori retains the right to assume control of legal proceedings where indemnification applies.
Part 11: Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Before pursuing formal action, you agree to contact us at info@dektori.com to attempt to resolve disputes informally.
If informal resolution is not possible, disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Arbitration will take place in Boston, Massachusetts, unless otherwise agreed. Claims may be brought only in an individual capacity; class actions or consolidated claims are not permitted. You waive any right to a jury trial in disputes related to these Terms or your use of the Platform.
Part 12: Termination
You may close your account at any time by discontinuing use of the Platform. Dektori may suspend or terminate your access, in whole or in part, without prior notice, if you violate these Terms, misuse the Platform, or if legal or business reasons require it. Upon termination, your right to use the Platform ceases immediately. We may delete data associated with your account unless law requires retention.
Part 13: Modifications to the Terms
We may revise these Terms at any time. Updates will be posted on the Platform with a revised effective date. Continued use of the Platform after changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Platform.
Part 14: Entire Agreement and Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dektori regarding your use of the Platform. They replace all prior agreements, whether written or oral, relating to the same subject matter. If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.
A failure by Dektori to enforce any right or provision does not waive that right or provision. Headings used in these Terms are for convenience only and have no legal effect. You may not assign or transfer your rights or obligations under these Terms without our written consent. Dektori may assign its rights and obligations without restriction. These Terms will bind and benefit both parties and their successors or permitted assigns.
Part 15: De-Identification of Records
Dektori may de-identify health information for internal purposes, including research, service improvements, or legitimate business use. Once data has been de-identified, it cannot reasonably be traced back to you. De-identified information may be analyzed to improve Platform performance, evaluate trends, and develop new features, while ensuring your privacy is preserved.

Dektori respects intellectual property rights. If you believe content on the Platform infringes your copyright, you may submit a written DMCA notice to info@dektori.com. The notice must include:
Part 17: Linking and Framing
You may link to the Platform in a fair and legal way that does not damage Dektori’s reputation or suggest false endorsement. You may not frame the Platform within another site without our written consent.
Part 18: Enforcement of Terms
Dektori reserves the right to determine whether these Terms have been violated. If violations occur, we may suspend or terminate your account, remove content you have posted, issue warnings, pursue legal remedies including damages, or refer matters to law enforcement. Dektori is not liable for any damages you may suffer as a result of such enforcement actions.
